Now in Force – Prohibition of Certain Toxic Substances Regulations, 2025 and Export Control List Amendments

Posted Date: 2-July-2026

Health Canada is Introducing a Revised Guidance for Industry on Notifying Health Canada of Foreign Actions, effective October 1, 2026.

Just a reminder that, as of June 30, 2026, the Prohibition of Certain Toxic Substances Regulations, 2025, and the related amendments to the Export Control List under CEPA are now in force.

The 2025 Regulations repeal and replace the Prohibition of Certain Toxic Substances Regulations, 2012, further restricting the manufacture, use, sale and import of PFOS, PFOA, LC-PFCAs, HBCD and PBDEs, while also introducing new controls on Dechlorane Plus (DP) and decabromodiphenyl ethane (DBDPE). Certain time-limited exemptions and permit provisions are available to support transition to alternatives.

The Regulations also introduce new laboratory reporting requirements for DP and DBDPE, with reporting to be submitted through Environment and Climate Change Canada’s Regulatory Services Platform.

Amendments to the Export Control List also came into effect at the same time. These amendments add export controls for PFOA, LC-PFCAs, HBCD, PBDEs and ferbam, supporting Canada’s obligations under the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade. Dechlorane Plus (DP) has also been added to the Export Control List; however, this listing will not come into force until December 31, 2030.

Companies that manufacture, import or export any of the affected substances should review the new requirements and determine whether any permit or reporting obligations apply.
