The enforcement of 1999 Canadian Environmental Protection Act (CEPA) is live and well as Environment and Climate Change Canada’s (ECCC) enforcement officers work hard everyday to make sure individuals and companies are respecting Canadian environmental laws. Recently, Collingwood Prim Reality Holdings Corporation and its director were sentenced in the Ontario Court of Justice for offences under the Canadian Environmental Protection Act, 1999 related to contraventions of the PCB regulations. The court sentences the director to a 45-day jail time failing to comply with an environmental protection compliance order. The also sentenced the corporation and the director to pay a combined penalty of $420, 000 to be directed to the Federal Environmental Damages fund. This is a reminder from Cosmetics Alliance to membership that CEPA enforcement possible and it could possibly lead to jail time if violated.
