The Natural and Non-prescription Health Products Directorate (NNHPD) has developed a new guidance document titled, How to apply for market authorization for a non-prescription drug in Canada. This guidance document was developed to clarify Health Canada’s authorization process for non-prescription drugs (NPDs).
The importance of this guidance extends beyond simply providing another source of information for applicants. For many years, stakeholders have had to navigate a regulatory framework in which the requirements and processes applicable to NPDs have been distributed across legislation, multiple guidance documents, individual web pages, application forms, policies, standards and other sources. In addition, some aspects of the regulatory process have historically been understood through interactions with Health Canada rather than being clearly articulated in publicly available guidance. This has created a significant interpretive and administrative burden, particularly for companies that are new to the Canadian market.
The publication of this guidance is a positive development. It should also serve as a foundation for continued work to consolidate and modernize the broader NPD regulatory framework, including the various guidance documents, policies, monographs, standards and administrative processes that collectively determine how products can enter and remain on the Canadian market.
