Precision Regulating Authorities

The Food and Drugs Act (FDA) via the Budget Implementation Act 2024 (C-69), that received Royal Assent on June 20, 2024 was changed to include these authorities for the Minster of Health.
These amendments provide the Minister of Health with new tools to enable tailored regulatory solutions to respond to situations that could affect the health and safety of Canadians. When a situation requiring action has been identified and where the pre-conditions in the legislation have been met, these new authorities allow the Minister to:

  • Put in place supplementary rules for certain therapeutic products to protect against potential health risks or adverse effects
  • Put in place targeted exemptions from specific regulatory requirements for therapeutic products or food or
  • Rely on information or decisions from select foreign regulatory authorities to satisfy specific regulatory requirements for therapeutic products or food

Health Canada has posted their overview explaining the objectives of this legislation and details on the new powers the Minister of Health has for:

  • Supplementary rules authority
  • Exemption authority and
  • Decision of foreign regulatory authority
