CMR Consultation Released

On October 2, 2026, Health Canada and Environment and Climate Change Canada published a consultation on the development of regulations establishing criteria for determining whether substances are carcinogenic, mutagenic or toxic to reproduction (CMR) under CEPA. The comment deadline is December 2, 2026.

The proposed CMR criteria will be used to determine whether a substance that has already been deemed to be toxic under section 64 of CEPA meets the criteria for addition to Part 1 of Schedule 1. For substances meeting the prescribed criteria, the Ministers must recommend their addition to Part 1, where priority is given to the total, partial or conditional prohibition of activities or releases involving the substance.

CA Canada encourages members to review the proposed CMR criteria carefully and provide input. The criteria will establish an important threshold for determining which substances are subject to the Part 1 Schedule 1 framework and its associated risk-management requirements. Members are encouraged to consider the proposed criteria in relation to substances relevant to their products and provide any comments, concerns or technical information that may help inform the consultation.

CA Canada is reviewing the consultation and will engage with our technical committees to provide comments. Members who would like to provide input to CA Canada are encouraged to contact the CA Regulatory Team at regulatory@cosmeticsalliance.ca.
