On May 15, 2026, Health Canada published a Notice of Intent to introduce a Ministerial Order that will exempt certain low-risk, non-prescription drugs from traditional, extensive New Drug Submissions. Part of the federal “Red Tape Reduction” mandate, this regulatory reform aims to fast-track market entry for products like sunscreens, acne therapies, toothpastes, and medicated skincare by leveraging pre-existing safety data from trusted foreign jurisdictions. Under the new framework, qualifying active ingredients with a documented history of safe use abroad will be “pre-cleared” and added to product monographs, allowing manufacturers to secure expedited marketing authorizations without undergoing a lengthier pre-market review.
While the notice establishes the eligibility categories based on established low-risk lists, the practical, logistical details of how this exemption will function day-to-day are still being drafted. Cosmetics Alliance is actively working with health officials to iron out this implementation specifics and is soliciting feedback from its members to help shape the policy. Health Canada plans to draft the formal Ministerial Order this summer with an expected publication in the Canada Gazette in Fall 2026, while Cosmetics Alliance pushes for a direct final order to implement the changes as swiftly as possible.
