Règlement modifiant le règlement relatif aux dispositifs médicaux (licences d'établissement)

Health Canada is proposing significant amendments to the Medical Devices Regulations (MDR) to modernize the MDEL framework, aiming to streamline processes, enhance international alignment, and improve supply chain oversight. Currently, requiring both foreign distributors and Canadian importers to hold an MDEL is seen as a redundant and unnecessary burden on industry. The core proposed changes are: removing the MDEL requirement for foreign distributors who sell to an MDEL-holding Canadian importer, thereby reducing regulatory costs and better aligning with other jurisdictions; requiring all MDEL applicants and holders to provide and annually update supplier information to ensure Health Canada maintains traceability and can efficiently monitor foreign risk; and explicitly requiring MDEL holders to establish, implement, and maintain all documented safety management procedures, closing compliance gaps observed during inspections. These amendments are intended to reduce industry burden, particularly for small businesses, while ensuring the continued safety and effective management of medical devices on the Canadian market.
